Bideshi Rai @ Ravindra Kumar YadavversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to specified conditions.

Summary

The petitioner, Bideshi Rai (Ravindra Kumar Yadav), sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act concerning alleged recovery of 237 litres of concealed liquor. He argued that the liquor was not found in his possession, the recovery site did not belong to him, and the FIR omitted the informant’s name, suggesting a weak prosecution case. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and a six‑week period for the trial court to verify the petitioner’s criminal antecedent. The order further stipulated that if more than three prior cases are found, the bail would not be confirmed, whereas confirmation would follow if only three prior cases are verified.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
