Holding

The Court provisionally granted anticipatory bail, subject to bail bonds, sureties and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Vidyanand Sahani, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 28.5 litres of liquor from a bush. He argued that the liquor was not found in his possession, the location did not belong to him, and the case was based on secret information without proper investigation. The State opposed the bail, contending the seriousness of the offence. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.5,000 with two sureties and subject to verification of the petitioner’s criminal antecedent. The order stipulated that if more than one prior case is found, the bail would not be confirmed; if only one prior case is found, the bail would be confirmed forthwith.

Issues considered

  • What is the appropriateness of granting anticipatory bail in a case under Section 30(a) of the Bihar Excise Act?
  • Whether the petitioner’s alleged lack of possession and the nature of the evidence justify bail?
  • Whether the conditions imposed under Section 482(2) of the BNSS are proper for provisional anticipatory bail?

  • excise law
  • Section 30
  • Section 482
