The Court granted provisional anticipatory bail with conditions, subject to verification of the petitioner’s antecedent.
Summary
The petitioner, Sujit Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 120 litres of liquor from an auto near the Falgu River. He contended that he was not arrested at the spot, no liquor was found in his possession, the vehicle was not his, and the complaint originated from a watchman with whom he had an inimical relationship, raising doubts about the investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs 30,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If more than six prior cases are found, the bail will not be confirmed; if only six, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in view of the alleged offence under the Bihar Prohibition and Excise (Amendment) Act, 2022 and his criminal antecedent.
