The Court ordered provisional anticipatory bail for the petitioner, subject to bond, sureties and verification of antecedents, with confirmation contingent on a clean record.

Summary

The petitioner, Ranjit Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where 197.280 litres of liquor were allegedly recovered from a vacant premises not owned by him. He argued that the allegation was based solely on a confessional statement of a co‑accused made in police custody and that no liquor was found in his possession, and that the 2018 amendment to the Excise Act had abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 and two sureties of the same amount, subject to verification of the petitioner’s criminal antecedents under Section 482(2) of the CrPC. If the petitioner is found to have a clean record, the bail will be confirmed; otherwise, it will not be confirmed. The order emphasizes the need for the trial court to verify antecedents before confirming bail.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 based on the facts presented.
  • Whether a confessional statement made by a co‑accused in police custody can be the sole basis for denying anticipatory bail.
  • Whether the post‑2018 amendment concepts of deemed possession and presumed offender are applicable to the present case.
