Patna High Court

Vivek Kumar @ Vivek Kumar RaiversusThe State Of Bihar

Decided
Disposal
DISPOSED

Holding

The court held that, given the petitioner’s clean antecedent and lack of possession, provisional anticipatory bail should be granted subject to verification of antecedents under Section 482(2) of the CrPC.

Summary

The petitioner, Vivek Kumar, feared arrest in a case registered under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act for the alleged recovery of 680 litres of spirit from a Maruti car, which he did not own and from which nothing was found in his conscious possession. He pleaded that he has a clean antecedent and that the investigation was based solely on secret information without proper inquiry. The State opposed the grant of anticipatory bail. The High Court, after considering the submissions, ordered provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his criminal antecedents. The order is subject to Section 482(2) of the Code of Criminal Procedure, and if any antecedent is discovered, the bail will not be confirmed. If the verification confirms a clean record, the provisional bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s clean antecedent and lack of possession justify the grant of anticipatory bail.

                                  5. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender within a period of six weeks

from today, be released on provisional anticipatory bail on

furnishing bail bonds of Rs.500/- (Rupees five hundred) with

                                  6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the

event if it is found that petitioner has antecedent of even one

case, in that event, it would be presumed that petitioner had

concealed his antecedent before this court, as such, the

provisional anticipatory bail order shall not be confirmed but if

on verification it is found that petitioner is a person with clean

                     shall be confirmed forthwith.
