DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner subject to specified conditions.

Summary

The petitioner, Siyaram Singh, sought anticipatory bail fearing arrest in a case under Sections 30(a), 32(3) and 56(b) of the Bihar Prohibition and Excise Act relating to the alleged recovery of liquor from a godown and two vehicles. He argued that he had no conscious possession of the liquor and was merely the owner of one of the seized vehicles, unaware of any misuse by a third party. The State opposed the bail, contending that the allegations warranted detention. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties, a deposit of Rs.1,500 with the Advocate Association, and verification of the petitioner’s criminal antecedent. The order stipulated that if any antecedent is discovered, the bail would not be confirmed, whereas a clean record would lead to immediate confirmation.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C.
  • Whether ownership of a vehicle used in the alleged offence implicates the petitioner.
  • Whether the petitioner poses a risk of fleeing or tampering with evidence.
