Holding

The petition to quash the FIR was dismissed because the case had become infructuous following the acquittal of the accused.

Summary

The petitioners sought quashing of an FIR registered on 23 May 2014 under IPC sections 419, 420, 467, 468 and 471. The court observed that the criminal trial arising from the FIR had already concluded, with the accused being acquitted on 20 December 2024. Since the substantive case was disposed, the FIR had become infructuous. The State had no objection to the petition. Consequently, the High Court disposed of the petition as infructuous, without granting any order to quash the FIR.

  • Whether an FIR can be quashed when the underlying criminal case has already been disposed and the accused acquitted
