Patna High Court

Pramod RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted because the accused had a clean antecedent, no direct incriminating material, and the custody period was reasonable.

Summary

The petitioner, Pramod Rai, was arrested in connection with the recovery of 185 litres of liquor from a boat under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed innocence, stating no incriminating material was found on him and that the recovery occurred in a public area. The petitioner had no prior criminal record and had been in custody since 3 November 2025, with alleged non‑compliance of Section 103 of the Bihar Narcotic Substances (Suppression) Act, 2023. The State opposed bail, but the court considered the clean antecedent, lack of direct evidence, and the duration of custody. Consequently, the court granted bail on a bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the non‑compliance of Section 103 of the B.N.S.S., 2023 affects the grant of bail.

Subjects

  • bail
  • prohibition law
