Shiv Nath RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to bond and conditions.

Summary

Shiv Nath Ray was arrested in connection with a case where 360 litres of liquor were recovered from his residence, leading to charges under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he had no direct possession of the liquor, that the recovery was from a joint family house, and that he had no prior criminal record. He also argued that the prosecution had not complied with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the court, noting the lack of incriminating material against the petitioner, his clean antecedent, and the duration of his custody, decided to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties and specific conditions regarding appearance and future conduct.

Issues considered

  • Whether bail should be granted to the petitioner under the charges of Sections 274, 275 BNS and 30(a) Bihar Prohibition and Excise Act
