Provisional anticipatory bail was granted subject to verification of the petitioner’s criminal antecedent, with confirmation contingent on the antecedent not exceeding five prior cases.
Summary
The petitioner, Amar Nut, sought anticipatory bail after learning of an FIR under Section 30(a) of the Bihar Prohibition and Excise Act alleging recovery of 105 litres of liquor from a location not belonging to him. He argued that he was not in possession of the liquor, that the complaint was instigated by a hostile chaukidar, and that the police had not conducted a proper investigation. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.25,000 with two sureties and that the trial court verify his criminal antecedent. The order stipulated that if the verification shows more than five prior cases, the bail would not be confirmed; if only five, the bail would be confirmed. Thus, the petitioner was released provisionally pending verification of his antecedent.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise Act.
- Whether the petitioner’s prior five cases under the Excise Act affect the grant of anticipatory bail.
- Whether the alleged recovery of liquor from a place not in the petitioner’s possession justifies denial of bail.

7. However, it is made clear that thereafter the learned

petitioner has antecedent of only five cases in that event the
provisional anticipatory bail order shall be confirmed forthwith.
