The Court conditionally granted provisional anticipatory bail to the petitioner, subject to verification of his criminal antecedent and compliance with the stipulated bail conditions.
Summary
Manoj Kumar Singh applied for anticipatory bail after the police registered a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 alleging that 83.07 litres of liquor were recovered from his Mahindra XUV‑500. The petitioner argued that he was not arrested at the spot, had no conscious possession of the liquor and was unaware that a co‑accused, Ratnesh Kumar Singh, would misuse his vehicle. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs 5,000 with two sureties and conditioned on verification of the petitioner’s criminal antecedent under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS Act. If the petitioner is found to have more than one prior case, the bail will not be confirmed; otherwise it will be confirmed. The order also required the petitioner to deposit Rs 5,000 with the Patna High Court Advocate Association.
