BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Akhilesh Kumar, was arrested in connection with the alleged recovery of 865.59 litres of liquor from a pickup vehicle and charged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was not the owner of the vehicle, was not arrested at the spot, and was implicated by a local person without proper investigation, and he had been in custody since 17 March 2026. The petitioner, represented by Ms. Sripriya Sinha, sought bail, arguing he would not abscond and would cooperate with the trial. The State, represented by Mr. Arun Kumar, opposed the bail. The court, after considering the submissions, ordered the release of the petitioner on bail upon furnishing a bond of Rs.5,000 with two sureties of the same amount, directing compliance with the trial court’s conditions.
