Rupchand Uraon @ Rupchand Kumar UraonversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The court refused bail, holding that the seriousness of the allegations and supporting evidence preclude the grant of bail.

Summary

Rupchand Uraon, arrested on 16 January 2026, sought bail in connection with FIR No. 362 of 2025 alleging offences under Sections 64, 126(2), 115(2), 303(2) of the BNS and Sections 4 and 8 of the POCSO Act, including rape of a 17‑year‑old girl. The petitioner claimed the allegations were fabricated, while the State highlighted the victim’s statement recorded under Section 183 of BNSS, 2023 and a supporting medical report. The court examined the seriousness of the charges, the victim’s recorded statement and medical evidence, and concluded that these factors warranted denial of bail. Consequently, the petition for bail was refused.

petitioner and Ms.Asha Kumari, learned Additional Public

                   Prosecutor for the State.

                                2. The petitioner seeks bail, who is in custody since

16.01.2026 in connection with Dhamdaha P.S. Case No. 362 of

2025, F.I.R. dated 13.12.2025 registered for the offence

punishable under Sections 64,126(2),115(2),303(2) of BNS and

Sections 4, 8 of the POCSO Act.

                                3. Allegation against the petitioner is that he

committed rape upon the victim, aged about 17 years.

                                4. Learned counsel appearing for the petitioner

submits that the allegation as alleged in the FIR is false and

fabricated and the petitioner has not committed any offence as

                   alleged in the FIR.

                                                         2/2

                                    5. Learned A.P.P. for the State, on the other hand, has

vehemently opposed the prayer for bail of the petitioner and

submits that as per allegation in the FIR, the petitioner has

committed rape upon the victim, aged about 17 years and apart

from that, the statement of the victim was recorded under

Section 183 of BNSS, 2023 in which she has categorically

stated that the petitioner has committed rape upon her and she

has also fully supported the case of the prosecution as well as

medical report of the victim also supports the allegation as

                       alleged in the FIR.

                                    6. Considering the nature of allegation against the

petitioner in the FIR, the statement of the victim was recorded

under Section 183 of BNSS, 2023 in which she has

categorically stated that the petitioner has committed rape upon

her supported by the medical evidence, I am not inclined to

enlarge the petitioner on bail in connection with Dhamdaha P.S.

Case No. 362 of 2025 pending in the court of learned Additional

                       Sessions Court-VII-cum-Spl. Court (POCSO), Purnea.

                                    7. Prayer is refused.
