Suresh Manjhi @ Suresh Prasad ManjhiversusThe State of Bihar

Decided
Disposal
PARTLY ALLOWED (DISPOSAL)

Holding

The Court granted anticipatory bail to Suresh Manjhi subject to bond and conditions under Section 438(2) Cr.P.C. and Section 482(2) B.N.S.S.

Summary

The petitioners sought anticipatory bail in connection with FIR No. 311 of 2025, which alleged offences under several sections of the Bhartiya Nyay Sanhita, 2023, including abuse and assault of an informant. Petitioners Suresh Manjhi and his son Niraj Madhukar filed the application; the latter withdrew his request, leaving only Suresh Manjhi's petition. The petitioner argued that the allegations were vague, that there was no intent to outrage the informant's modesty, and highlighted his clean antecedent. The State opposed the bail, contending the seriousness of the offences. The Court, noting the lack of specific allegation against Suresh Manjhi and his clean record, granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to Suresh Manjhi despite the FIR alleging abuse and assault.
  • Whether the FIR contains sufficiently specific allegations to deny bail.
  • Whether the petitioner's clean antecedent warrants bail under the applicable provisions.
