The Court grants bail to the petitioner subject to a bond of Rs.15,000, two sureties and conditions of appearance and conduct.
Summary
Lalbabu Sah was arrested in connection with the seizure of 213 litres of Nepali liquor from his residence and charged under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act. The petitioner contended that he had no direct possession of the liquor, that the recovery was from a joint family house, and that no incriminating material linked him personally to the offence. He also highlighted that the investigation had not complied with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and pointed to his nine prior criminal antecedents. The State opposed the bail application, arguing the seriousness of the offence. After considering the length of custody, lack of personal possession, and the joint‑house circumstance, the Court inclined to grant bail, imposing a bond of Rs.15,000 with two sureties and specific conditions regarding appearance and future conduct. The bail was ordered subject to these conditions.
Issues considered
- Whether bail should be granted to the accused under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act given the facts of joint‑house recovery and prior antecedents
- Whether non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the bail decision
