The court granted bail to the petitioner with specified conditions.

Summary

Manish Kumar Yadav applied for bail in a case (PS Alamanj Case No. 235 of 2026) where 62 litres of illicit country-made liquor were seized from a semi‑constructed house linked to him under Section 30(a) of the Bihar Prohibition & Excise Act. The petitioner claimed innocence, arguing that the seizure was made from an open, semi‑constructed structure and that the police failed to comply with Section 105 of the BNSS during the seizure. The State opposed bail, highlighting the petitioner’s criminal record of seventeen cases, eight of which involve similar offences. After hearing both sides, the court considered the circumstances, the petitioner’s custody since 13‑03‑2026, and the need for cooperation in trial. The court granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of personal appearance, a relative as bailor, and a prohibition on future similar offences.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition & Excise Act.
  • Whether the police complied with Section 105 of the BNSS during the seizure of the illicit liquor.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
