Holding

The Court granted provisional anticipatory bail subject to bail bond, sureties, and verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Rakesh Kumar, applied for anticipatory bail fearing arrest in a case under Sections 30(a), 32(3) and 33 of the Bihar Prohibition and Excise Act for alleged recovery of 420 litres of spirit from a public field. He argued that the police had no direct possession of the contraband, that the recovery site did not belong to him, and that the investigation relied on secret information and prior similar cases. The State opposed the bail, contending the seriousness of the offences. The Court, considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.30,000 with two sureties and that the trial court verify his criminal antecedents. The order further stipulated that if more than six prior excise cases are found, the bail would not be confirmed; otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 482(2) of the B.N.S.S. in a case involving alleged excise offences.
  • Whether the lack of recovery from the petitioner’s possession and reliance on secret information affect the propriety of the investigation.
