Patna High Court

Abhay PanjiyaraversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The regular bail application was allowed, and the petitioner was released on bail subject to bond and surety conditions.

Summary

The petitioner, Abhay Panjiyara, was arrested in connection with offences under IPC sections 147, 148, 149, 302 and 307 and Arms Act section 27, and has been in custody since 7 June 2025. He earlier filed a regular bail application which was rejected, but after the charges were formally framed on 13 March 2026, he renewed his bail prayer. The petitioner argued that he was not the actual assailant and that the specific allegations of firing were against others. The State opposed the bail, citing the seriousness of the offences. The Court, after considering the submissions, ordered the petitioner’s release on bail upon furnishing a bond of Rs. 25,000 with two sureties, one being his father, and warned that the trial court could cancel the bail if he attempts to delay the trial. Consequently, the regular bail application was allowed.

Issues considered

  • Whether bail should be granted to an accused charged with serious offences including murder and rioting under the IPC and Arms Act.
  • Whether the framing of charges alters the bail position of the accused.
  • Whether conditions can be imposed on bail to prevent trial delay.

counsel for the petitioner, the petitioner above-named, is directed

to be released on bail on furnishing bail bonds of Rs. 25,000/-

the trial in any manner, in that event, the learned Trial Court shall

be at liberty to cancel the bail bonds of the petitioner.

                                   8. Accordingly, the instant regular bail application
