Patna High Court

Raees @ Tetna @ RaisversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

The petitioner, Raees, sought anticipatory bail after an FIR was lodged under several provisions of the Bharatiya Nyaya Sanhita and the Dowry Prohibition Act relating to alleged rape, dowry demands, and assault. The FIR alleged that the petitioner married the informant, demanded dowry in the form of a motorcycle, gold and cash, and subsequently assaulted and evicted her for non‑payment. The petitioner feared arrest in connection with the case (PS No. 74 of 2025). The Court examined the seriousness of the allegations, the nature of the offences, and the statutory criteria for granting anticipatory bail. Considering the gravity of the charges, the Court refused the petition for anticipatory bail. Consequently, the petitioner remains liable to be arrested under the pending FIR.

Issues considered
