Anticipatory bail was granted to the petitioners subject to bond and surety conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
The petitioners, Renu Devi and Ranju Kumari, women from Ramdani village, were implicated in a police case (PS Case No. 454 of 2025) arising from a land‑dispute‑related scuffle during which police officers were attacked and a police vehicle was damaged. The prosecution alleged that the petitioners participated in the assault and vandalism, charging them under multiple sections of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Prevention of Damage to Public Property Act, 1984. The petitioners contended they were innocent, not present at the scene, and were being falsely implicated due to an ongoing land dispute; they sought anticipatory bail, offering to cooperate with the investigation. The State opposed the bail. After considering the facts, the court held that the petitioners could be released on bail, subject to a bond of Rs 10,000 each with two sureties and conditions under Section 482(2) of the B.N.S., 2023. Consequently, the petitioners were granted anticipatory bail pending further proceedings.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under the circumstances of the case
- Whether the allegations against the petitioners justify their arrest under the charged sections
