Patna High Court

Mojahid @ Mohammad MojahidversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner on condition of a Rs.5,000 bond and two sureties.

Summary

Mojahid, a resident of Pathraha village, was arrested in connection with the alleged recovery of 75 litres of liquor from a maize field and charged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 (Amended), 2022. He applied for bail, asserting a clean antecedent, lack of possession of the liquor, and that the alleged recovery occurred on land not owned by him and accessible to villagers. The prosecution opposed bail, but the court noted the absence of any material linking the petitioner to the contraband and his willingness to cooperate with the trial. Considering these factors, the court ordered his release on bail upon furnishing a bond of Rs.5,000 with two sureties of equal amount. The bail order was directed to be complied with before the trial court handling the case.

Issues considered

  • Whether bail should be granted to the petitioner in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 (Amended), 2022.
