Patna High Court

Durga Bind @ Durga BinversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, directing him to furnish a bail bond of Rs.5,000 with two sureties.

Summary

The petitioner, Durga Bind, was arrested in connection with the alleged recovery of 120 litres of liquor from a public area behind a school, under Section 30(a) of the Bihar Prohibition and Excise Act. He argued that the liquor was not found in his possession, the location did not belong to him, and the informant’s name was omitted from the FIR, casting doubt on the prosecution’s case. He also highlighted his prior criminal antecedents and asserted that he would not abscond if released on bail. The State opposed the bail, but the court, after considering the submissions, ordered his release on bail upon furnishing a bond of Rs.5,000 with two sureties of the same amount. The bail order was directed to be complied with by the trial court handling the case. The petitioner has been in custody since 25 March 2026.
