Patna High Court

Ranjeet Bhagat @ Ranjeet Kumar @ Ranjeet BindversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner due to the absence of independent witnesses and the presence of a counter‑case.

Summary

The petitioner, Ranjeet Bhagat, was arrested in connection with an assault and extortion case filed under several sections of the Bihar Penal Code. He contended that the FIR was fabricated as part of a counter‑case against him and that there were no independent eyewitnesses. The State opposed his bail application. The court examined the FIR and noted the absence of any independent witnesses and the existence of a dispute between the parties, indicating that the allegations might be false. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties of equal amount, subject to the satisfaction of the concerned Judicial Magistrate. The bail order was pronounced by Justice Ramesh Chand Malviya.

Issues considered

  • Whether the petitioner is entitled to bail in the assault and extortion case under the Bihar Penal Code.
  • Whether the lack of independent eyewitnesses and the existence of a counter‑case justify granting bail.

Subjects

  • bail
  • criminal procedure

2 28-01-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                 2. The petitioner is in custody in a case registered for

the offence punishable under Sections 191(2), 191(3), 190,

                   126(2), 115(2), 109(1), 352, 351(2) of the BNS.

                                 3. As per allegation in the FIR, it is a case of assault

and demand of extortion money from the informant and his

family members by the petitioner and the co-accused persons.

                                 4. The learned counsel for the petitioner submits that

the petitioner is innocent and has falsely been implicated in this

case as the whole allegation in the FIR is being manipulated and

the real scenario is that there is case and counter case between

the parties for which Pipariya PS Case No. 29 of 2025 has been

instituted at the behest of the petitioner’s side and to save from

this case, the petitioner has been implicated in the present case.

Petitioner is in custody since 04.11.2025 and there is no

independent eye witnesses of the alleged occurrence.

                                 5. Learned APP for the State opposes the prayer for

                    bail of the petitioner.

                                 6. On perusal of FIR and impugned order dated

09.12.2025, it appears that there is no independent eye witnesses

of the alleged occurrence and there is case and counter case

between the parties, so let the above named petitioner be

released on bail on furnishing bail bond of Rs. 10,000/-(ten

thousand) with two sureties of the like amount each to the

satisfaction of Miss Gazila Saveena, Judicial Magistrate, 1st

Class, Lakhisarai/concerned Court in connection with Pipariya

                    P.S. Case no.- 26 of 2025.
