BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond of Rs. 10,000, two sureties, and compliance with conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Sonam Kumar, was implicated in a criminal case arising from a land dispute in which he and co‑accused allegedly assaulted the informant and his sons and allegedly stole Rs. 1 lakh. The petitioner claimed innocence, arguing that the injuries were minor, there was no intent to cause death, and the theft allegation was unfounded. The informant contended that the petitioner caused a fracture to his left hand and his sons' heads, though later conceded no fractures were observed. Considering the simple nature of injuries, the background of a bona‑fide land dispute, and the counter‑version, the Court ordered the petitioner to be released on bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 482(2) of the B.N.S.S. and attendance requirements. The bail order was conditioned on the petitioner surrendering within eight weeks and complying with the stipulated conditions.

Issues considered

  • Whether the petitioner is entitled to bail in view of the nature of the alleged offences and the circumstances of the land dispute
