Holding

The Court granted provisional anticipatory bail with conditions, subject to verification of the petitioner’s criminal antecedents.

Summary

Arjun Rai applied for anticipatory bail after a case was registered against him under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged possession of 600 litres of liquor in a Scorpio vehicle. He argued that he was not arrested on the spot, did not own the vehicle, and was implicated solely on secret information without proper investigation. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., directing the trial court to verify his criminal antecedents. If more than two prior cases are found, the bail will not be confirmed; if only two, the provisional order will be confirmed. The order is conditional and pending verification.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s alleged lack of ownership of the seized vehicle and reliance on secret information affect the grant of bail.
  • Whether the petitioner’s prior criminal antecedents (two cases) justify denial of anticipatory bail.
