Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Pintu Kumar, was arrested in connection with offences under Sections 126(2), 352, 351(2), 3(5) of the B.N.S, 2023 and Section 20 of the Arms Act. The prosecution alleged that unknown miscreants had abused an informant and threatened his driver, with one miscreant allegedly pointing a weapon at the driver. The only link to the petitioner was his name appearing in the confessional statement of co‑accused Vicky Kumar; no material was recovered from the petitioner and he had been in judicial custody since 28‑02‑2026 despite a prior criminal case. The petitioner’s counsel argued innocence and lack of evidence, while the State opposed bail. After hearing both sides, the court found the evidence insufficient to justify continued detention and ordered the petitioner’s release on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being named in a co‑accused’s confessional statement and having a prior criminal antecedent.
