The court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with conditions under Section 482(2) of the BNSS.
Summary
The petitioner, Chandan Ray, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 4.125 litres of liquor from a motorcycle he owned. He argued that he had no knowledge of the liquor being in the vehicle, had a clean criminal record, and was not in possession of the liquor at the time of arrest. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and conditions under Section 482(2) of the BNSS, directing the trial court to verify his antecedents. The order stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act.
- Whether the lack of possession and clean antecedent justify granting anticipatory bail.
