Decided

DISMISSED

Holding

Bail is denied.

Summary

Golu Kumar was arrested for allegedly attempting to forcibly snatch jewellery at gunpoint, an offence charged under section 309(5) of the B.N.S., 2023 and section 27 of the Arms Act. After the informant raised alarm, locals intervened and the petitioner was apprehended, though he later fled the scene. He has been in custody since 24‑11‑2025 and is also accused in three other criminal cases. The petitioner applied for bail. Considering the seriousness of the alleged offences and the fact that he is a repeat accused, the court declined to grant bail, noting that the order is confined to the present bail application and does not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the petitioner under section 309(5) B.N.S., 2023 and section 27 Arms Act in view of the alleged violent conduct.
  • Whether the existence of three additional pending criminal cases justifies the denial of bail.
