The court granted bail to the petitioners with conditions of bond, sureties, and mandatory appearance at trial.
Summary
The petitioners, Radha Paswan and Surya Don (Sonu Paswan), were charged under several sections of the B.N.S., 2023 and Section 27 of the Arms Act for allegedly firing 40 rounds at an informant’s door. They contended that they were falsely implicated, that the informant owed them money, and that they themselves were the victims, having sustained gunshot injuries while no one else was hurt. Both had been in judicial custody since December 2025. The State opposed bail, highlighting the petitioners’ extensive criminal antecedents (four and nine prior cases respectively). After hearing both sides, the court granted bail to each petitioner on a bond of Rs. 10,000 with two sureties, subject to their cooperation and presence at every trial date.
Issues considered
- Whether bail should be granted despite the seriousness of the offences under the B.N.S., 2023 and the Arms Act
- Whether the petitioners’ prior criminal antecedents justify denial of bail
- Whether the petitioners are likely to cooperate with the trial and not tamper with evidence
