Decided

BAIL GRANTED

Holding

The court allowed the bail application, granting regular bail with conditions.

Summary

The petitioner, a marketing officer, was arrested in a vigilance case for allegedly accepting a bribe of Rs.10,000 and has been in custody since December 18, 2025. He filed a regular bail application under Section 7(a) of the Prevention of Corruption Act, claiming innocence and alleging false implication. The prosecution opposed the bail, noting that a charge‑sheet had been filed. After considering the submissions and the length of custody, the court granted bail on the condition of a Rs.10,000 bond with two sureties and required the petitioner to appear regularly in court. The court clarified that its observations were prima facie and would not affect the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 7(a) of the Prevention of Corruption Act despite the seriousness of the alleged offence
  • Whether the existence of a charge‑sheet warrants denial of bail

                       5. Learned A.P.P. for the State and the learned counsel
