Patna High Court

Nitesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court inclined to grant bail to the petitioner.

Summary

Nitesh Kumar was arrested after 300 litres of liquor were recovered from a cowshed and charged under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner argued that he had no incriminating material in his possession, the liquor was found in an open public area, he has no prior criminal record, and the police failed to comply with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail. Considering the circumstances, the court found the petitioner’s claim of innocence plausible and the period of custody reasonable, and therefore granted bail on condition of a Rs.15,000 bond with two sureties. The order releases the petitioner pending trial.

Issues considered

  • Whether bail should be granted to a person accused under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants bail.
