PANKAJ KUMARversusThe State of Bihar

DISPOSED

Holding

The Court ordered provisional anticipatory bail subject to conditions and verification of antecedents, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Pankaj Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where 30.375 litres of liquor were recovered from a motorcycle not owned by him. He argued that the seizure was based on secret information, he had no conscious possession of the liquor, and that the police had not conducted a proper investigation. The State opposed the bail. The Court granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedents. If more than three prior cases are found, the bail will not be confirmed; if three or fewer, it will be confirmed. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
  • Whether the circumstances of seizure and lack of possession justify the grant of anticipatory bail.
