Holding

The bail application is dismissed; the petitioner is not entitled to bail.

Summary

The petitioner, Deep Prabhat, was arrested in connection with a case registered under Mahila Police Station, Munger (Case No. 32 of 2025) for alleged sexual abuse of a minor and extortion. The charges include offences under Sections 64, 351(2) and 3(5) of the Bihar Narcotic/Criminal Statutes (BNS) 2023 and Section 4 of the Protection of Children from Sexual Offences (POCSO) Act. The prosecution presented the victim’s recorded statement under Section 183 of the BNSS, which corroborated the allegations. The petitioner, who has been in custody since 26‑10‑2025, applied for bail. The Court, after hearing, found the evidence sufficient to deny bail and dismissed the application.

Issues considered
