Holding

The Court granted anticipatory bail to the petitioner, subject to bail bond and surety conditions under Section 482(2) of the BNSS.

Summary

Antima Kumari, a minor and sister of the main accused, applied for anticipatory bail fearing arrest in a kidnapping case (Pakridayal P.S. Case No. 376 of 2025) involving offences under Sections 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 8 and 12 of the POCSO Act. The prosecution alleged her participation in the kidnapping of a girl, while her counsel asserted her innocence. The State and the informant opposed the bail. The Court, after considering the submissions and the circumstances, allowed the anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the BNSS. The order ensures her release if arrested within four weeks, pending trial.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the facts of the case
  • Whether the allegations under the Bharatiya Nyaya Sanhita and the POCSO Act justify denial of anticipatory bail
  • Whether the conditions prescribed under Section 482(2) of the BNSS are applicable
