Holding

The Court granted regular bail to the petitioner, directing him to furnish a bail bond of Rs.5,000 with two sureties.

Summary

The petitioner, Ranjay Kumar, was arrested on 17 February 2026 for alleged possession of 266.4 litres of liquor recovered from a motorcycle, an offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He contended that he had no prior criminal record and was falsely implicated, as he was merely passing through the area where the seizure took place and was not the owner of the vehicle. The State opposed his request for regular bail. After hearing both sides, the Court considered the petitioner's clean antecedents and the circumstances of the alleged incident. The Court ordered his release on bail upon furnishing a bond of Rs.5,000 with two sureties of the same amount, subject to the satisfaction of the trial court. The bail order effectively disposed of the petition.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, given the facts of alleged false implication and his clean antecedents.
