Patna High Court

Ravish kumar @ Ravish @ SiriousversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions stipulated by the Court.

Summary

The petitioner, Ravish Kumar, sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bharatiya Nyaya Sanhita relating to a violent incident on 29‑August‑2025 where hostel students attacked an informant and his friends. The FIR did not name the petitioner; his name emerged only in a co‑accused’s confessional statement without any specific allegation of participation. The petitioner argued innocence and highlighted that another accused, Sabina Haque, had already been granted anticipatory bail in a related proceeding. The State opposed the bail application. The Court, after considering the lack of direct accusation and the petitioner’s absence from the FIR, held that anticipatory bail was appropriate, subject to conditions. Accordingly, the Court ordered that the petitioner be released on anticipatory bail if he surrenders within eight weeks, with a bail‑bond of Rs 10,000 and two sureties, under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted when the petitioner is not named in the FIR but is mentioned in a co‑accused’s statement without a specific role.
  • Whether the conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, are applicable to the grant of anticipatory bail.
