Patna High Court

Shri Krishna Mahto @ Krishna KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Shri Krishna Mahto applied for bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022. He has seven prior cases, one involving alleged recovery of 494.64 litres of liquor from a co‑accused’s straw house, but he was not arrested at the scene and no liquor was found in his possession. He contends that he was implicated by a hostile chowkidar and that the police are mechanically charging persons with criminal antecedents. The State opposed bail. The court, after considering the submissions, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, to be satisfied by the trial court.

Issues considered

  • Whether bail should be granted to the petitioner in an offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022, considering his criminal antecedents and the circumstances of the alleged offence.
