Patna High Court

Lal Babu @ Lal Babu RayversusThe State of Bihar

Decided

Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of antecedents, with confirmation contingent on the outcome of that verification.

Summary

The petitioner, Lal Babu Ray, sought anticipatory bail fearing arrest in a case under Sections 274, 275 and 3(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act, relating to alleged recovery of 439.200 litres of liquor from two vehicles. He argued that he was not arrested on the spot, no liquor was found in his possession, and he does not own the seized vehicles, claiming the police relied on secret information to implicate him. The State opposed the bail. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on a Rs.5,000 bond, two sureties, and verification of the petitioner’s criminal antecedents. If the verification shows more than one prior case, the bail will not be confirmed; if only one prior case is found, the bail will be confirmed. The order is subject to the provisions of Section 482(2) of the Bihar Narcotic Substances Act.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether the petitioner’s alleged involvement in the liquor seizure warrants arrest.
  • Whether the petitioner’s prior criminal antecedent affects the grant of bail.

2 06-05-2026 1. Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offence punishable under Sections 274, 275

                   Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of one case under the Excise Act and

allegation is of recovery of 439.200 litres of liquor from two

different vehicles. It is next submitted that petitioner was not

arrested from the spot as such nothing was recovered from his

information which is the easiest way to implicate someone. It is

also submitted that Ravi was apprehended but then he did not

disclose the name of the petitioner. It is also submitted that once

an accused is implicated in a case relating to excise, the police

starts implicating mechanically either through chowkidar, local

person, confessional statement or secret information without

          holding a proper investigation.

                       4. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       5. Considering the submissions made by the learned

          B.N.S.S.

                       6. It is made clear that the learned trial court thereafter

one case, in that event, it would be presumed that petitioner had

concealed his antecedent before this court, as such, the
