BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

Arjun Mahto was arrested in connection with a case alleging possession of 300 litres of Nepali liquor, violating Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution’s evidence consisted of the liquor recovered from the house of a co‑accused, with no material found in the petitioner’s direct possession. The petitioner contended that he was falsely implicated, had no involvement in the recovery, and that his name was supplied by a local chowkidar; he also pointed out the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Despite having one prior criminal antecedent, the court considered the circumstances and the period of custody already served. The High Court granted bail, directing the petitioner to furnish a bond of Rs. 15,000 with two sureties of equal amount.
