The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with the stipulated conditions.

Summary

The petitioner, Sonu Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 9.7 litres of liquor near the dalan of Rajunandan. He contended he had no prior criminal record and that the liquor was not found in his possession, the allegation being based solely on a confessional statement made by his father while in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties, a requirement to deposit Rs.1500 with the Advocates’ Association, and a condition that the trial court verify the petitioner’s antecedent within six weeks. If any prior case is discovered, the bail would be revoked; otherwise, the provisional order would be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of the petitioner’s father, made in police custody, can be the sole basis for the accusation.
