Provisional anticipatory bail was granted subject to conditions and pending verification of the petitioner’s criminal antecedent.

Summary

The Patna High Court entertained an application for anticipatory bail filed by Dinesh Singh, who was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly possessing 15 litres of liquor and having a motorcycle seized. The petitioner contended that he had no conscious possession of the liquor, that the vehicle was merely owned by him and was misused by another person, and that he had a clean criminal record. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, ordered provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed verification of the petitioner’s antecedent by the trial court. The order further stipulated that if any prior case is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act.
  • Whether ownership of a vehicle used in the alleged offence implicates the owner for anticipatory bail purposes.
  • Whether the petitioner’s clean antecedent is a condition for confirming anticipatory bail.
