Lal Babu PrasadversusThe State of Bihar

Holding

The Court ordered provisional anticipatory bail, subject to verification of the petitioner’s antecedent cases and compliance with the stipulated conditions.

Summary

The petitioner, Lal Babu Prasad, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, where 2.160 litres of liquor were allegedly recovered from a bicycle not owned by him. He has seven prior cases under the Excise Act and claims he was implicated by a local person without any material seized from his possession. He applied for anticipatory bail, which the State opposed. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on a bail bond of Rs.35,000 with two sureties and directed the trial court to verify his criminal antecedents. If more than seven prior cases are found, the bail will not be confirmed; if exactly seven, the bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 given his antecedent record and the circumstances of the alleged seizure.
