Patna High Court

Rohit Kumar @ Rohit RajversusThe State of Bihar

Decided

The Court provisionally granted anticipatory bail subject to bond, sureties and verification of antecedents.

Summary

The petitioner, Rohit Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 15 litres of liquor recovered from a scooty. He argued he had a clean antecedent, was not the vehicle's owner, and the case was based solely on a confessional statement of another accused, which he claimed lacks evidentiary value. He also contended that the 2018 amendment to the Excise Act abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail on a modest bond and sureties, subject to verification of the petitioner’s criminal antecedent, with the order to be confirmed if he is found to have a clean record.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 of the Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether a confessional statement of a co-accused can alone justify arrest and denial of bail.
  • Effect of the 2018 amendment removing deemed possession on the grant of anticipatory bail.
