Holding

The Court granted provisional anticipatory bail subject to bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Himanshu Kumar, sought anticipatory bail fearing arrest in a case under Sections 111 and 3(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, relating to the alleged recovery of 1,313.28 litres of liquor from a truck. He argued that he was not arrested on the spot, had no conscious possession of the liquor, was not the vehicle owner, and was implicated solely on secret information without a proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If the antecedent exceeds two cases, the bail will not be confirmed; if it is exactly two, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic Substances Act.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 Cr.P.C. in a case involving alleged excise offences and narcotic provisions.
  • Whether the reliance on secret information without a proper investigation justifies denial of bail.
  • Whether the petitioner’s prior criminal antecedent (more than two cases) should affect the confirmation of anticipatory bail.
