Holding

The Court conditionally granted provisional anticipatory bail, subject to bail bonds, sureties, and verification of the petitioners' criminal antecedents.

Summary

The petitioners, three brothers, applied for anticipatory bail fearing arrest under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged possession of liquor recovered from a joint family house and nearby locations. They argued that no liquor was found in their conscious possession, the house is jointly owned, and the concept of deemed possession was abolished after the 2018 amendment, contending that the complaint was motivated by a hostile chaukidar. The State opposed the bail, citing the seriousness of the offence and the petitioners' prior excise cases. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on the petitioners furnishing a bail bond of Rs.10,000 with two sureties and subject to verification of their criminal antecedents. The order further stipulated that if verification shows more than the disclosed antecedents, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 438 of the Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the alleged possession of liquor in a joint family house amounts to a cognizable offence despite the absence of conscious possession.
  • Whether the petitioners' prior excise cases affect the grant of anticipatory bail.
