Holding
The court granted bail to the petitioner with conditions.
Summary
Shashi Bhushan Kumar was arrested in connection with a case involving the alleged possession of 5 litres of country-made liquor, a gas stove and utensils, alleged under Section 30(a) of the Bihar Prohibition and Excise Act and Sections 274 and 275 of the Bharatiya Nyaya Sanhita, 2023. The petitioner claimed innocence, arguing that no incriminating material was found in his personal possession and that the recovery was made from an open public area. He had been in custody since 6 December 2025 and possessed three prior criminal antecedents, with the prosecution not complying with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the court, considering the circumstances and the period of custody, decided to grant bail subject to a bond of Rs. 15,000 with two sureties and conditions regarding family surety and regular court appearances. The bail order was issued by Justice Rudra Prakash Mishra.
Issues considered
- Whether bail should be granted despite the petitioner’s three prior criminal antecedents
- Whether the lack of material found in the petitioner’s possession and the open‑place recovery negate the charge
- Whether non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects bail eligibility
