Patna High Court

Lav KumarversusThe State of Bihar

DISPOSED

Holding

The court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

Lav Kumar, the petitioner, faced arrest in a case under Sections 30(a) and 32(3) of the Bihar Excise Act for allegedly transporting 7.44 litres of liquor in a motorcycle. He argued that he was not in possession of the liquor at the time of seizure and that the vehicle was misused by another person, Sumant, who was apprehended at the spot. The petitioner also disclosed five prior criminal cases, four of which were under the Excise Act, and sought anticipatory bail. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail on the condition of furnishing a bail bond of Rs. 25,000 with two sureties and directed the trial court to verify the petitioner’s antecedent; if more than five prior cases are found, the bail would not be confirmed. The order is subject to Section 482(2) of the BNSS and pending verification by the trial court.

Issues considered

  • What is the appropriateness of granting anticipatory bail to a petitioner with multiple prior criminal cases, including under the Excise Act?
  • Whether the petitioner’s ownership of the vehicle, without possession of the seized liquor, suffices to deny culpability under Sections 30(a) and 32(3) of the Bihar Excise Act.

Subjects

  • anticipatory bail
  • Bihar Excise Act
  • vehicle ownership
  • criminal antecedent
  • Section 482
  • seizure of liquor

                             3. Learned counsel for the petitioner submits that the

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the seized

create evidence against himself and hence would get implicated,

it is further submitted that petitioner was completely unaware

                   7. It is made clear that thereafter the learned Trial
