Holding

The court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

The petitioner, Rohit Paswan, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act concerning the alleged recovery of 936 litres of liquor from a public road. He argued that the liquor was not in his conscious possession, the location did not belong to him, and the investigation relied on secret information without proper inquiry. The State opposed the bail. The court, considering the submissions, granted provisional anticipatory bail conditioned on a Rs.15,000 bond with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If the antecedent exceeds three cases, the bail will not be confirmed; if it is exactly three, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic and Psychotropic Substances Act.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged offence under the Bihar Prohibition and Excise Act and his criminal antecedent.

petitioner was not arrested from the spot, as such, nothing was
