The Court granted anticipatory bail to the petitioner, subject to bond and conditions, under Section 482(2) of the B.N.S.S.

Summary

Bala Paswan applied for anticipatory bail after being implicated in a case (PS No. 15 of 2026) for possession of 40.875 litres of illicit foreign liquor seized near Kamla Dam. The prosecution alleged violation of Section 30(a) of the Bihar Prohibition and Excise Amendment Act. The petitioner argued innocence, claiming the recovery was from an open public area and that his name was linked only through co‑accused statements. The State opposed the bail. The High Court, noting the open‑place recovery and lack of direct connection, granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and conditions under Section 482(2) of the B.N.S.S., including regular court appearances and non‑interference with witnesses.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act
  • Whether the recovery of liquor from an open public place affects the likelihood of the petitioner’s involvement and justifies bail
