Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to a bond and sureties, considering the consensual relationship and marriage.

Summary

The petitioner, Chandan Kumar, was arrested in a case alleging that he enticed a minor girl, the informant’s daughter, and later married her. The FIR listed offences under Sections 137(2), 96, 352, 351(2), 3(5) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) and later added Section 8 of the POCSO Act. The petitioner argued that the victim, in her statement under Section 183 BNSS, voluntarily went with him, married him, and now lives as his wife, a fact not contested by the opposite party. The court considered the consensual nature of the relationship, the marriage, and the statutory provisions governing bail. It ordered that the petitioner be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) Cr.P.C. and Section 482(2) BNSS. The bail order was conditioned on surrender within four weeks if arrested.

Issues considered

  • Whether bail can be granted to the accused in a case involving alleged offences under BNSS and the POCSO Act
  • Whether the consent and subsequent marriage of the minor affect the applicability of the charges
  • Whether the conditions under Section 438(2) Cr.P.C. and Section 482(2) BNSS are satisfied
